Terms of Service

1. Agreement to Terms

By accessing or using The Daily Lesson at thedailylesson.com (the "Service"), operated by Lesson of the Day, PBC ("LOTD," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Service Description

The Daily Lesson provides AI-generated educational content delivered as daily lessons in up to 47 languages, live classes with an AI tutor named Kelly, vocabulary enrichment through Word Orb, and related tools. Content is available across four age bands (kids, teen, adult, elder) and four learning tracks (learn, grow, teach, trivia).

3. Accounts and Identity

You may browse lessons without an account. To access live classes, progress sync, and subscription features, you must create an account using a valid email address. We use passwordless magic-link authentication.

You are responsible for maintaining access to the email address associated with your account. You must not share your session credentials or allow unauthorized access to your account.

Multi-device: Your account may be accessed from multiple devices. All devices share a single identity, progress history, and subscription status.

Age requirement: If you are under 13 years old, your parent or legal guardian must create a Family account and add you as a profile. Direct accounts for users under 13 are not permitted. See our Parental Consent Policy.

4. Subscriptions and Payment

Plans

The Service offers three subscription tiers: Monthly, Yearly, and Family. All plans include a 7-day free trial (credit card required). Current pricing is available at /pricing.

Purchasing Power Parity

We offer regionally adjusted pricing based on your country (Bands A through E). Your billing band is determined at checkout from your IP-based country and may be attested to a different band once in Settings. Band E (sanctioned/blackout regions) is sponsor-subsidized at no cost to the learner.

Billing

Subscriptions are billed in advance via Stripe. You authorize recurring charges at the interval you selected. You may cancel at any time from /you → Settings; cancellation is effective at the end of the current billing period.

Refunds

If you are unsatisfied, contact hello@thedailylesson.com within 30 days of your most recent charge for a full refund. After 30 days, refunds are at our discretion.

Lifetime Legacy Members

Users who purchased a Founding Member or Lifetime subscription prior to the effective date of these Terms retain lifetime access with full feature parity. They will not be billed and may participate in the affiliate program.

5. Live Classes

Live classes are group sessions (typically 3 learners) with Kelly, our AI tutor. Classes are scheduled on-demand and require an active subscription and completion of the day's lesson in the relevant language and age band.

Classes may be recorded for quality, safety, and replay purposes. Recordings are available to attendees for 24 hours and are then deleted. By joining a class, you consent to recording.

Kids-age-band classes require a parent or guardian to maintain an active Family account and provide parental consent.

6. Affiliate Program

Subscribers may participate in our affiliate program and earn commissions on referred subscriptions. Commission is 10% of gross charges from referred users for the lifetime of their subscription. A 20% bonus applies to the first charge. Full terms: /affiliate-agreement.

You may purchase gift subscriptions for others. Gift terms, delivery, and redemption are governed by our /gift-terms.

All content, including lessons, Kelly's persona, visual assets, and the Word Orb vocabulary system, is owned by Lesson of the Day, PBC. Patent pending: US Application 18/088,519. Trademarks: The Daily Lesson, Kelly, iLearn, Word Orb.

You may share lesson excerpts for personal, non-commercial use with attribution. Commercial redistribution requires written agreement.

10. Content Accuracy

Lessons are AI-generated, reviewed for accuracy, and age-filtered. We do not guarantee all content is factually correct. The Daily Lesson does not provide medical, legal, or financial advice.

11. Termination

We may suspend or terminate your account for violation of these Terms, fraudulent activity, or abusive behavior in live classes. You may delete your account at any time from /you → Settings.

Upon account deletion, your personal data is removed per our Privacy Policy. Affiliate attribution edges are severed (future commissions cease; past payouts are retained per legal requirements).

12. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOTD IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Los Angeles County, California.

14. Changes to Terms

We may update these Terms. Material changes will be communicated via email to registered users at least 14 days before taking effect. Continued use constitutes acceptance.
